New Era of Regulation

Updated: Feb 16, 2023

A new era of regulation is upon us.

Not just by governments, but also through the economic dominance of banks, large corporations, and the super giant social media, for more than a decade, regulatory initiatives claiming justification on the basis of the need to combat terrorism, or to prevent money-laundering, or tax-evasion (so-called CTF or AML or KYC) or privacy and data protection and even to support international economic sanctions, have been implemented around the world.

Because the regulations have been implemented by multiple countries and institutions, they are not consistent and have created confusion and uncertainty seriously affecting normal business activities.

How are businesses to respond and navigate this jungle of international red tap of compliance, corporate social governance which is increasingly interfering with normal business activities, increasing cost and adversely affecting efficiency. How should a company deal with compliance issue? How to resolve the problem of balancing the need for compliance without diminishing the ability of ordinary companies and individuals to conduct their lawful businesses freely and privately. These questions are regularly being raised by our clients and they form an increasingly important part of our daily legal services.
